Millionaire divorce case changed everything for stay-at-home mothers

Postby admin (daniella) » Wed Apr 12, 2017 9:58 am

Millionaire businessman Mr Work was ordered to pay his wife half his £140m fortune in 2015, but fought the court’s decision, saying that his wife ‘stayed at home’ during their two decades long marriage, during which she raised their two children. He argued that he made all the family’s money and claimed to posses a “quality of genius” that enabled him to do this without the support of his wife.

Today, the Court of Appeal disagreed and dismissed Mr Work’s appeal. He must now pay his estranged wife half his fortune, after the judge accepted she was a 'good homemaker and good mother', adding that it was down to her willingness to move to Japan that the husband was able to amass his wealth.

Reading this and other posts, I don't think it changed anything. It actually reinforces the status quo and makes the (huge) amount of money irrelevant to the principle.

Put it this way, had the amount of money been say £150,000 split 50/50 no one would blink an eye, because that's not a fantastic amount of money given her contribution to the relationship. He argued that he had already given her a fantastic settlement (probably true) and that his genius(!) was the reason he was so successful and wealthy. The judge dismissed that and opinioned that it was as much as luck as judgement and didn't change her overall contribution.

It's the amount of money involved that makes the story not the 50/50 ruling.

50/50 is the default position, whatever the relative roles. You have to argue pretty well to change that, and this 'genius' obviously couldn't.
